This case involved compensation for a teacher who had been unfairly dismissed. A key issue was whether the Ministry was also jointly liable for the compensation along with the school or was just a regulator.

Background

A teacher submitted a complaint to the Labour Office because her employment contract was unfairly terminated. The dispute could not be resolved amicably, so the case was referred to the Court of First Instance who suspended the implementation of the dismissal decision and forced the school principal to pay the teacher's salary from the date of termination until the issue of a ruling .

The teacher then requested that both the General Director of the Special Education and the Undersecretary of the Education Ministry be included in the case and amended her request to compel the defendants and the headmaster to pay her late salary, an allowance in lieu of notice and a compensation of 30000 Egyptian Pounds.

The court rejected the headmaster's claim for no formal standing, and ordered the defendants to jointly pay compensation for unfair dismissal in addition to pay in lieu of notice and late salary.
