This case involved a claim for compensation by individual who had been beaten. The criminal ruling was not yet final so could not be used as evidence in the civil case.

Background

The claimants filed a case against defendants before the court requesting the defendants to pay them 25000 Egyptian Pounds as compensation for damage which had resulted from them being beaten by the defendants.

The court dismissed the case made by the second claimant and ruled that the defendants should pay the first claimant the estimated compensation.

The defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The defendants appealed the ruling before the court of cassation and said in their grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. It was said that they maintained before the court that the criminal ruling had not become final yet. The defendants also said that the court had established its ruling based on the argument that first defendant had caused injury for the first claimant though he had caused injury to another claimant.
