ECC 395/1999

This case involved a claim by a Central Bank employee for the alteration of their appraisal and their promotion. As the Central Bank is a public entity decisions of this nature involved Administrative law and should be covered by the Administrative courts.

Background

An employee filed a case against the Central Bank before the first instance court requesting the dismissal of an assessment report for 1993/1994 and their promotion to a higher grade.

The court ruled that that the assessment grade given to the employee should be ‘Excellent' and that he should be promoted to Deputy general manager.

The Central Bank appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the assessment report should be dismissed.

Decision

The central bank appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had erred in the application of law because the Central Bank is one of the legal entities under public law and Decisions by the Central Bank on its employees are administrative decisions which the administrative court should consider.
