This case involved a claim for compensation by heirs after the death of an individual in a road traffic accident. The car owner filed a sub claim against an insurance company. The renewal of the original claim alone did not allow the court to oppose the sub case which the plaintiff had not requested to proceed with.
Background
Some citizens filed a case before the Court of First Instance against an insurance company and a car owner requesting them to compensate them for the damage caused because of the accidental death of their predecessor. The car driver was convicted of a criminal offence and the insurance company to pay 51 Egyptian Pounds to the injured citizens as compensation. The owner of the car filed a sub claim against the insurance company.
The court dismissed the case because the plaintiffs had not attend the hearing .The car owner and the insurance company asked to proceed with their request, and the court compelled them to pay compensation and in the sub-case, the court ruled in favour of the plaintiffs.
