Personal Injury – Criminal Case – Road Traffic Accident – Litigation Procedure – Statute of Limitations – Insurance
This case involved a claim for compensation following injury in a road traffic accident. The date used for the calculation of the statute of limitations should be the date from which the criminal case against the driver was abandoned.
Background
Some claimants filed a case against an insurance company before the court requesting the company pay them compensation for damage which had resulted from car accident. The claimants said that a criminal ruling was issued against the driver and the car was insured by the company at the time of accident.
The court ruled that the company should pay the claimants the estimated compensation.
The claimants and the company appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
