Background

An employee filed a case against a bank before the court requesting the dismissal of an appraisal report for the period from 01/04/1995 to 31/03/1996 and the amendment of his grade to ‘Excellent'.

The court ruled that the grade should be amended to ‘Very Good'.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The bank appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had erred in the application of law and that the commission of employees' affairs was the entity that had mandate over the appraisal of the employee's performance and that the court had ignored the decision made by this commission.
