Background
Two claimants filed a case against a company before the court requesting the validation of their possession of some disputed land. The claimants said that the first claimant had bought the land on 23/02/1958. The claimants said that the first claimant sold half the land to the second claimant in 1991. The claimants said that the company had seized the land in 1994.
The court dismissed the case.
The claimants appealed the ruling before the court of appeal. The court ruled that the claimants' possession of the land should be validated.
Decision
The company appealed the ruling before the court of cassation and said in its grounds of appeal that the ruling had erred in the application of law and that the disputed land was owned by the state and that the claimants had no right to own it by the period of limitation. The company said that the claimants' possession of the land was not dismissed by force.
