ECC 2147/1999

This case involved a claim for compensation by an employee who it was said had suffered disability as a result of a workplace injury. Key issues included whether the National Authority for Social Insurance should be liable and if it had been satisfactorily proven the injury had resulted for a workplace incident which was the employer's fault.

Background

A employee filed a case before the Court of First Instance against a company and requested compensation amounting to 100000 Egyptian Pounds for disability he had suffered at work. During investigation, the plaintiff requested that the director of the National Authority for Social Insurance be included in the case as an opponent.

The court issued a ruling compelling both the company and the second defendant to pay the worker an amount as compensation.

All parties filed an appeal .The court partly cancelled the appealed ruling on the second defendant's compensation and dismissed the case for being filed without having capacity. In the plaintiff's appeal, the court reduced the amount of compensation requested from the company.
