This case involved the cancellation of an employee's transfer to a new company and the payment of a bonus by that new company. It was wrongly ruled the new company should pay the bonus when that new company had not been set up yet and lacked legal character.
Background
An employee filed a case against two companies before the court of first instance requesting the dismissal of a transfer decision from the first to the second company and payment of an annual bonus starting from 01/07/1988. The employee said that the transfer decision had violated the rules of Egypt Law No. 48/1978.
The employee dismissed his case against the first company. The court ruled that the second company should pay the employee 112 Egyptian Pounds.
The legal representative of the second company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
