ECC 1505/1999

The initial dispute involved a request for interim compensation, A claimant said the defendant had insulted them during a court case but the criminal case had been given up. An agreement not to litigate was not violated by the request for compensation.

Background

A claimant made a complaint against a defendant requesting to be penalized and to pay a temporary compensation of 51 Egyptian. The claimant said that the defendant had insulted her during a court hearing. The claimant then gave up the criminal case and the court referred the civil case to the civil court.

The defendant filed a case against the claimant requesting the claimant pay him compensation for damage.

The court ruled that the case made by the defendant should be dismissed. The court ruled the defendant should pay the claimant 5000 Egyptian Pounds in addition to 50000 Egyptian Pounds as compensation.

The claimant and the defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
