ECC 149/1999
Background
A claimant filed a case against defendants before the first instance court requesting their appointment as a development and credit manager or as senior inspector.
The court ruled that the claimant had the right to be appointed a senior inspector starting from 28/01/1993 and the defendant should pay him 369.600 Egyptian Pounds in addition to the monthly difference of 9 Egyptian Pounds.
The first and second defendant appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.
Decision
The first and second defendants appealed the ruling before the court of cassation and said in their grounds of appeal that the ruling had violated the Article 1 of Egypt Law No. 5/1991 which stipulated that filling a leadership position should comply with the rules of this law. The defendants said that the claimant did not meet the qualifications required for being a senior inspector.
