This case involved a claim for a citizen against a bank and other individuals for compensation after they had been awarded compensation and interest under a decision which was then declared unconstitutional by the court. The court had been to demand the full amount when the plaintiff had not asked for this.
Background
A citizen filed a case before the Court of First Instance against a bank and citizens requesting a compensation of 34834,213 Egyptian Pounds and interest because they were entitled to get full compensation after they had been compensated 15,000 pounds under the provisions of Egypt Decision No. 134/ 1964 which was held as being unconstitutional by the Federal Supreme Court.
The Court of First Instance issued a ruling compelling the bank to pay the plaintiff 9610,471 Egyptian Pounds .The plaintiff filed an appeal asking for the same requests while the bank requested that the appealed ruling would be dismissed. The Appeal court compelled the bank to pay the plaintiff 34834,213 Egyptian Pounds with interest.
