ECC 1121/1999

This case involved a request by an employee who had been part of an early retirement scheme for an increase in amounts due as he had been referred to the scheme before a law came into force.

Background

An employee filed a case against a company and the National Organization for Social Insurance before the court of first instance requesting the increase of his salary by 15% starting from 01/07/1989.

The court ruled that the salary of the employee should be increased by 15% starting from 01/07/1989.

The National Organization for Social Insurance appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.

Decision

The employee appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had erred in the application of law and that he was referred to an early retirement scheme on 30/06/1989, namely before the issue of Egypt Law No. 124/1989 and thus deserved a salary increase.
