Court - Jurisdiction - Foreign Arbitration - Setting Aside
This case involved whether the Egyptian Courts had jurisdiction to rule on the setting aside of a foreign arbitration award.
Background
On 15 September 1997, a Danish arbitral tribunal issued an award in favour of a party against a trade and maritime company. An individual then filed a lawsuit before the Cairo Court of Appeal in his capacity as a former shareholder and director of trade and maritime company requesting suspension of the enforcement of the award and seeking to have it set aside. The other party objected to the jurisdiction of the Cairo Court of Appeal, arguing that the Parties had not agreed on the application of the Egyptian Arbitration Law. T
