This case was a small claims tribunal case where none of the mandatory jurisdictional gateways applied but at the consultation with the judge both parties had verbally stated they wanted to opt in to jurisdiction. They were informed this had to be in writing and given a deadline to do so. However, one party later wrote to confirm it had decided not to opt into DIFC jurisdiction.

Background

The Claimants were Nico and Nolan, two individuals based in Abu Dhabi.

The Defendant was Nilan, a company located in Dubai.

On 3 August 2023, the Claimants filed a claim with the DIFC Courts’ Small Claims Tribunal seeking payment of sums allegedly owed by the Defendant to the Claimant of USD 12,000 pursuant to an agreement entered into between the parties dated 26 May 2022.

On 21 November 2023, the Defendant filed a Defence without Counterclaim.

On 8 January 2024, a consultation was listed at which the Claimants and the Defendant’s representative attended.
