This case involved a request to appeal a decision based on the approach taken to liquidated damages. The payment of expert costs was also considered.
Background
By an Appeal Notice, including the required application for Permission to Appeal, issued on 4 July 2024 the Claimant/Applicant and intending Appellant, Normandie, sought permission to appeal the Judgement of H.E. Justice Nassir Al Nasser in the Small Claims Tribunal of 20 June 2024.
2. The Judgement upheld the Applicant’s claim made against Norris (the “Defendant” in the lower court and the “Respondent” to the Application for payment of the amount of AED 106,375.09 and the court’s fees of AED 5,318.80. The following was ordered:
“1. The Defendant shall pay the Claimant the sum of AED 106,376.09
2. The Defendant’s counterclaim shall be dismissed.
3. The Agreement shall be considered terminated.
4. The Defendant shall pay the Claimant the court fees in the sum of AED 5,318.80.
5. The Defendant’s counterclaims shall be dismissed.
6. The Defendant shall bear the court fee of the Counterclaim.”
