Noel v Nakia

Background

This case involved a dispute between two companies registered in Dubai, UAE - Noel the Claimant and Nakia the Defendant over an unpaid invoice for services rendered by the Claimant to the Defendant in 2022.

On 20 July 2023, the Claimant filed a claim with the DIFC Courts' Small Claims Tribunal seeking payment of an invoice of AED 11,568.38. The Defendant failed to file an acknowledgement of service or defence to the claim. A Consultation was held on 8 December 2023 before SCT Judge but the parties were unable to reach a settlement. Under Rule 53.61 of the Rules of the DIFC Courts the matter was referred for determination at a hearing held on 9 May 2024, where the Claimant's representative attended, and the Defendant was absent.
