This case involved whether there were grounds for appeal based on the court's jurisdiction.

Background

It was arguable that clause 7.6 of the Employment Contract provided for the exclusive jurisdiction of the Dubai (non-DIFC) Courts. Whether this was so and, if it was, whether such an exclusive jurisdiction clause was effective to oust the jurisdiction of the DIFC courts were matters upon which the Court did not appear to have been addressed in any detail.

The appeal was to be made the subject of an oral hearing.

Each party should bear its own costs of this application.

Decision

The Defendant’s Application for Permission to Appeal succeeded. Each party was to bear theirown costs.
