This case involved a request for an interim injunction preventing the enforcement of a Kuwaiti judgment. There had been a promissory note deed of release under which it had been promised no direct or indirect claim of any kind would be taken involving a convertible loan and note. It was claimed the Kuwaiti decision on the enforcement of a New York Judgment had been obtained fraudulently. It had been agreed any dispute involving the deed of release would go to arbitration.
