Outstanding Invoices - Incorrect party name - Corrected
This case involved outstanding invoices. The claim had mistakenly been taken by a representative of the company rather than the company so the name in the claim was amended by the court.
Background
This claim related to outstanding pending invoices by the Defendant. The Claim Form dated 23 November 2022 in this matter appeared to name the Claimant as Miruba . In review of the Claim Form and the documents filed in support of it, it appeared that the Claimant, upon filing the Claim Form, erroneously included the name of a representative of the company alongside the company’s name. Given the nature of the dispute, such claims ought to have been brought by the company as an entity rather than a representative of the company in their personal capacity.
