Niran v Nysa

This case involved a request by an employer to take steps to cancel a visa of an employee who had been terminated but had not cooperated with the cancellation process. The employee made a counter claim involving harassment and discrimination. This was outside the statute of limitations which was calculated from the date of termination not the date of the employee's last payment.

Background

The Claimant was Niran , a company registered and located in the DIFC.

The Defendant was Nysa an individual who was employed by the Claimant.

The underlying dispute arose over the employment of the Defendant by the Claimant pursuant to an Employment Agreement dated 14 May 2018.

On 12 October 2023, the Claimant filed a claim with the DIFC Courts’ Small Claims Tribunal seeking a court order to cancel the Defendant’s employment visa.

On 26 October 2023, the Defendant filed her defence and counterclaim seeking AED 488,999.

On 1 November 2023, the Claimant filed its defence to the Counterclaim.

On 23 November 2023, a Consultation was held before the SCT Judge but the parties were unable to reach a settlement.
