Mustohi v Murip
This case involved an employee who claimed for unpaid salary, holiday pay and overtime. A key issue was the documentation of these amounts. The employer had made a counter claim that money was missing from the accounts and as the employer was a manager they were responsible. There was insufficient evidence on this point.
Background
The Claimant was Mustohi an individual filing a claim against the Defendant regarding his employment at the Defendant company.
The Defendant was Murip a company registered and located in the DIFC.
The underlying dispute arose over the employment of the Claimant by the Defendant pursuant to an Employment Agreement dated 12 September 2022. The Claimant commenced work with the Defendant on 18 February 2021.
On 11 September 2023, the Claimant filed a claim with the DIFC Courts’ Small Claims Tribunal seeking various payments related to his employment of AED 57,750.
On 13 September 2023, the Defendant filed an acknowledgment of service with the intention to defend all of the claim.
On 27 September 2023, a Consultation was held before the SCT Judge however the parties were unable to reach a settlement.
