Meper v Mosup
This case involved a claim and a counterclaim when there had been a contract to supply six doors but only four could be put in because construction workers discovered the wall which was to be knocked down to fit two of the doors was a supporting wall which could not be removed.
Background
The Claimant was Meper , a company registered in Dubai, and located in Dubai, UAE.
The Defendant was Mosup ( an individual, living in Dubai, UAE.
The underlying dispute involved alleged unpaid sums owed by the Defendant to the Claimant under an agreement dated 14 June 2021.
On 2 March 2023, the Claimant filed a claim with the DIFC Courts’ Small Claims Tribunal seeking payment from the Defendant for alleged unpaid invoices arising from the Agreement of AED 5,000.
On 9 March 2023, the Defendant filed an Acknowledgment of Service with the intention to defend the whole claim. The Defendant also filed a Counterclaim claiming AED 11,667.
The parties met for a Consultation with the SCT Judge but were unable to reach a settlement.
