Mintil v Mester

This case involved an employee who was dismissed from employment while on probation. The employee made a claim for non-payment of salary and the penalty for late payment on termination. A compensation claim was also made for a failure to cancel the employee's visa which it was said prevented him for obtaining alternative employment. There was also a claim for a failure to provide medical insurance as detailed in the employment contract.

Background

The Claimant was Mintil , an individual filing a claim against the Defendant regarding his employment at the Defendant company.

The Defendant was Mester , a company registered in the DIFC, Dubai, UAE.

The underlying dispute arose out of the employment of the Claimant by the Defendant pursuant to an employment contract dated 21 October 2022 with a start date of 24 October 2022. The Claimant’s monthly remuneration was AED 7,500.

On 16 December 2022, the Claimant was terminated by the Defendant company by way of email with immediate effect.
