Mubin v Mikrun

This case involved claims for unpaid salary, flight tickets, end of service gratuity pay, holiday pay and pay in lieu of notice by an employee. A key point was how this should be treated as the employee had not been terminated and they had not resigned. The place of work had instead been closed by the police and there was no indication of when it would reopen.

Background

The Claimant was Mubin , an individual filing a claim against the Defendant regarding his employment at the Defendant company.

The Defendant was Mukrin , a company registered in the DIFC.

3The underlying dispute arises over the employment of the Claimant by the Defendant pursuant to an employment agreement dated 12 December 2020 ). The Claimant commenced his employment with the Defendant on 15 August 2019.

On 18 January 2023, the Claimant filed a claim with the DIFC Courts’ Small Claims Tribunal seeking various employment claims in the sum of AED 51,518.

On 6 February 2023, the Defendant filed an Acknowledgment of Service with the intention to defend all of the claim.
