This case involved the comtempt of two worldwide freezing orders issued in support of the enforcement of a New York arbitration award. One of the orders had been breached as payments had been made from the relevant company to other related companies after the freezing order which were not seen as being part of the ordinary and proper course of business. The other order involved disclosure requirements which had either not been acted on or there had been delay in acting on them. Other issues included the appropriate evidence level for such a case and whether a deposition should still be considered as appropriate evidence when the witness had refused to be cross examined.
