Maina v MAJ Invest Limited
This case involved a consulting contract which included the provision of outsourcing services for 12 months, as a US company was setting up an entity in the DIFC. The contract was to begin when the DIFC entity obtained their license. Issues included who was the liable party as the contract had been with the US entity and penalties for early termination.
Background
The Claimant was Maina a company registered in the DIFC, Dubai, UAE.
The Defendant was Maj a company registered in the DIFC, Dubai, UAE.
The underlying dispute arose over a Consultancy Agreement dated 25 August 2020.
On 18 April 2022, the Claimant filed a claim against the Defendant seeking payment of 55,566 AED pursuant to the Defendant’s alleged breach of a contract entered into by the parties.
On 25 April 2022, the Defendant filed an Acknowledgment of Service setting out their intention to defend the entirety of the Claim.
The parties met for a Consultation with the SCT but were unable to reach a settlement.
