This case involved a Part8 application for a money order after a settlement agreement to pay a debt was breached. Issues included whether an individual who had not signed the settlement agreement but had been a guarantor of the debt and been involved in the settlement agreement disciussions should be liable.

Background

This was the Claimant’s Part 8 application for permission to grant them a money judgment order against the First Defendant (D1) and the Second Defendant (D2). The Application had not been opposed by D1 or D2. The Claimant applied to have the Application to be considered at an oral hearing, therefore a hearing was scheduled.
