Lanakila v (1) Lang (2) Lancelot (3) Laneetees

This case involved a property which had been let, then sublet. The original tenant had failed to pay the rent although the sub-tenant had paid them. Issues included whether the sub tenant should be evicted and if they should be responsible for paying outstanding rent, penalty payments and utility charges to the owner.

Background

The Claimant was Lanakila the Landlord of unit 0(the “Premises”).

The Defendant was Lang, a holiday home company located in the DIFC.

The Second Defendant was Lancelot, an employee of the First Defendant working as CEO.

The Third Defendant was Laneetees, an individual leasing the Premises.

On 17 February 2021, the Claimant and the First Defendant entered into an agreement to lease the Claimant’s Premises for one year starting from 21 February 2021 to 20 February 2022, for the annual rent of 55,000 AED (plus a conditional rent-free period from 21 February 2022 until 20 March 2022). The Claimant allowed the First Defendant to sub lease the Premises to third parties for the period of the First Lease Agreement.
