This case involved non-payment for construction equipment. The first defendant had failed to attend the hearing so the case was decided on the claimant's evidence which was sufficient. The Claimant was Laoghaire a construction equipment rental company registered in Dubai, UAE.
The First Defendant was Laquita - Umm Al Quwain, a construction company located in Umm Al Quwain, UAE.
The Second Defendant was Latoya, a construction company located in Abu Dhabi, UAE.
The underlying dispute arose over alleged unpaid invoices pursuant to a hire agreement signed by the Claimant and the First Defendant following which the First Defendant had failed to pay the Claimant the sums due under the Hire Agreement.
On 8 February 2022, the Claimant filed a claim in the DIFC Courts’ Small Claims Tribunal for payment of 107,124.59 AED, in addition to 9% interest on the judgment sum and Court fees.
