Lemma v Lancho
This case involved whether a tenant had the right to have their deposit returned because damage to the property was fair wear and tear for which she should not be liable.
Background
The Claimant Lemma was an individual who had rented a unit in the DIFC.
The Defendant Lancho was the owner of the Unit.
The underlying dispute arose over a tenancy contract entered into between the parties dated 9 November 2019 for a tenancy period from 9 November 2019 until 8 November 2020 which was extended until 8 January 2022.
On 31 January 2022, the Claimant filed a claim in the DIFC Courts’ Small Claims Tribunal seeking a refund of the security deposit of 5,000 AED.
There was a Consultation before the SCT Judge and both parties were in attendance, but failed to reach a settlement.
