This case involved a request to set aside a DIFC-LCIA arbitrations award. Although the parties had wanted a Dubai seated arbitration, when the issue had come before the Dubai courts they had stated they lacked jurisdiction because they interpreted the phase Dubai seat as meaning a DIFC seat. During the proceedings in the DIFC Courts deemed acceptance of the DIFC Court's jurisdiction had occurred. This did not mean the DIFC courts automatically had jurisdiction over the arbitration or DIFC Court Power to set aside the arbitral award.
