Minian (Middle East) V Mibad Investment

This case involved unpaid fees for legal work advising on a project and the resolution of a dispute. It was claimed there had been overcharging and negligence. Costs were also claimed. There was a procedure for disputing invoices which had not been followed and the company had continued to instruct the lawyers, only disputing the invoices when asked to pay.

Background

The Claimant was Menian (Middle East) a law firm registered in the DIFC.

2. The Defendant was Mibad Investments LLC  a real estate development company located in Dubai.

The underlying dispute arose over an alleged unpaid invoice for legal services and the scope of work set out in the Engagement Agreement dated 17 December 2017  signed between the Claimant and the Defendant.

On 30 September 2020, the Claimant filed a Claim seeking 478,031.95 AED as payment for outstanding legal fees; Interest of 0.88% per annum from the due date of each according to DIFC Law No. 7/2005 till the date of payment; and Court fees, and the Claimant's costs, fees and expenses incurred in connection with this Claim.
