This case involved a permission to appeal. It was considered there was a real prospect of success as this was a warehousing contract not a tenancy.

Background

This was an Appeal brought by the Claimant in this Claim, against the judgment issued on 8 November 2020. The Appeal Notice dated 14 October 2021 set out the Claimant’s request to determine the permission to appeal against the judgment on paper.

In accordance with RDC 44.19, permission to appeal may be granted in limited situations, which were when there was a real prospect that the appeal would succeed, or where there was another compelling reason why the appeal should be heard.

n review of the Appeal notice filed by the Claimant, the court found the Appeal did meet the requirements under ARDC 44.19.
