Leekhit v Liladhar

This case involved rent due after a rent cheque had bounced and unpaid amounts had not been paid. Issues included payment of a penalty for the bounced cheque and court fees. The tenant was also evicted and had to pay overstay rent.

Background

The Claimant was Leekhit the owner of a unit in the , DIFC, Dubai, UAE.

The Defendant is Liladhar the tenant of that Unit.

The underlying dispute arose over a tenancy contract which had been entered into between the parties dated 10 December 2020 for a tenancy period from 17 December 2020 to 16 December 2021. The Contract provided that the Claimant would rent the Unit for one year in return for 120,000 AED, which was to be paid in four instalments.

On 16 September 2021, the Claimant filed a claim in the DIFC Courts’ Small Claims Tribunal for 40,050 AED which consisted of unpaid rent that had fallen due as per the Contract.

The Defendant acknowledged service of this claim and provided a payment plan.

The parties met for a Consultation with SCT judges but were unable to reach a settlement.
