Larue v Lapid

This case involved unpaid amounts for an equipment hire contract. The claimant had attended the hearing but the defendant did not. The case was determined on the claimant's evidence only which was seen as sufficient.

Background

The Claimant was Larue, a company registered in Abu Dhabi, UAE.

The Defendant was Lapid, a company registered in Ras Al Khaimah, UAE.

The underlying dispute arose over unpaid invoices allegedly owed to the Claimant by the Defendant pursuant to a Hire Agreement signed by the parties,

On 9 June 2021, the Claimant filed a claim in the DIFC Courts’ Small Claims Tribunal for 170,588.63 AED and the court fee for the filing of this Claim.

The Defendant filed an acknowledgement of service setting out their intention to contest the jurisdiction of the DIFC Courts.

The DIFC Courts issued a Jurisdiction Order determining that it had jurisdiction to determine this claim.

At a consultation before the SCT Judge the parties failed to reach an agreement.

On 5 August 2021, at a hearing the Claimant’s representative was in attendance and the Defendant’s representative was absent.
