Lalitraj v Lajwati Restaurant 

This case involved an employee who had resigned due to non-payment of wages. Issues included his entitlement to unpaid salary, holiday pay, flight tickets, public holiday, an end of service gratuity and payments which should have been made to a qualifying scheme.

Background

The Claimant was Lalitraj an individual filing a claim against the Defendant on his employment at the Defendant company.

The Defendant was Lajwati Restaurant , a company registered in the DIFC located Tower, DIFC, Dubai.

The underlying dispute arose over the employment of the Claimant by the Defendant pursuant to an offer letter dated 9 November 2019. The Claimant was hired as a ‘Bartender’ with a monthly salary of 4,000 AED consisting of a Basic Allowance of 3,000 AED; and an Accommodation and transportation allowance of 1000 AED.

On 25 March 2021, the Claimant resigned due to unpaid dues, and served his notice until 10 June 2021.
