Labaca v Landi
This case involved whether a tenant could obtain the termination of a leasing contract, compensation and the return of a rent instalment because it was claimed a leak in the property had not been fixed in a timely manner.

The Claimant was Labaca a tenant in a DIFC Unit..
The Defendant was Landip, the Landlord of the Unit.
The underlying dispute arose over a tenancy contract entered into between the parties dated 17 May 2020 for a tenancy period from 4 July 2020 to 3 July 2021. The Contract stated the Claimant would rent the Unit for one year in return for 70,000 AED per year, to be paid over four instalments.
On 20 April 2021, the Claimant filed a claim in the DIFC Courts' Small Claims Tribunal seeking payment of 80,000 AED which consisted of damages, the refund of the last instalment and termination of the Contract without penalties.
The parties met for a Consultation with SCT Judge Delvin Sumo on 19 May 2021 but were unable to reach a settlement.
