Louriz v Leticia
This case involved an appeal from a decision of the Small Claims Tribunal in an employment case. There had been two contracts an independent contractor agreement and an employment contract. The first issue was whether under the independent contractor contract where no revenue had been generated monthly expenses were still due as an illustrative example in the contract showed from expenses being deducted from revenue earned. The second issue was the validity of the employment contract which stated that it had only been entered into for immigration purposes and had no other purpose. Damages and costs were also considered.
Background
This case was an appeal by the Claimant to the Court of First Instance from the Order dated 20 September 2021made in the Small Claims Tribunal, dismissing the Claimant’s claim against the Defendant.
