Lohith v Lokesh's Restaurant And Lounge DIFC/loshan Consulting Group
This case involved dues on termination for a restaurant employee who had asked to go on unpaid leave and this unpaid leave was extended as a result of the Presidential Decree on COVID-19. A key issue was whether he should be paid an accommodation allowance during this period and the notice period. Background
The Claimant was an individual filing a claim against the Defendant regarding his employment at the Defendant company which was, a restaurant company located in Gate Village, DIFC, Dubai.
The underlying dispute arose over the employment of the Claimant by the Defendant under an employment contract dated 29 October 2014. The Claimant's start date under the Employment Contract was 15 December 2014.
The Defendant terminated the Employment Contract on 27 July 2020.
On 13 July 2020, the Claimant filed a claim in the DIFC Courts' Small Claims Tribunal claiming his end of service entitlements of 18,000 AED.
On 21 July 2020, the Defendant filed their reply to the Claim with the intention to defend all of the claims.
