Lenox (Sharjah) Ltd v Lela International

This case involved an equipment hirer who had outstanding amounts on some invoices for hire. They asked for a payment plan because of the current financial situation but this was rejected by the claimant. The court ordered the full payment, costs and 9% interest.

Background

The Claimant is Lenox (Sharjah) Ltd  a company registered and located in, Sharjah, the UAE.

The Defendant was Lela International, a company registered in Dubai, located in Dubai, the UAE.

The underlying dispute involved the alleged non-payment of invoices following the Claimant's supply of various generators to the Defendant; which resulted in the Claimant issuing invoices for  998,533.57 AED in total.

On 7 June 2020, the Defendant filed an Acknowledgment of Service with an intention to contest the jurisdiction of the DIFC Courts.

On 29 June 2020, the SCT Judgedetermined by way of an Order that the DIFC Courts had jurisdiction to hear and determine this matter.

The parties failed to reach a settlement at the consultation.

The Claimant's case was that the parties entered into a hire agreement dated 16 January 2019, so the Defendant could hire products from the Claimant.
