Logan v Lucina

This case involved whether an employee was due commission payments on termination and a penalty for late payment of those dues.

Background

The Claimant Logan, was an individual filing a claim against the Defendant involving his employment at the Defendant company.

The Defendant was Lucina, a Foreign Recognized Company registered and located in the DIFC.

The underlying dispute arose over the employment of the Claimant by the Defendant under an employment contract dated 15 September 2018.

On 6 November 2019, the Claimant's employment was terminated  and his last working day was 5 January 2020.

On 5 February 2020, the Claimant filed a claim in the DIFC Courts' Small Claims Tribunal claiming alleged overdue commission, penalties under the DIFC Employment Law, and his flight allowance.

On 16 February 2020, the Claimant amended its Claim Form and this was accepted.

On 1 March 2020, the Defendant filed its defence.

The parties met for a Consultation but were unable to reach a settlement.
