Luna v Linie International Limited

This case involved a store manager who had had deductions made from their final salary on termination for disciplinary reasons and because stock and petty cash was missing from the store. The case looked at the legality of this, the award of costs and if a penalty for late payment of amounts on termination of employment was due.

Background

The Claimant Luna was an individual filing a claim against the Defendant about her employment at the Defendant's company.

The Defendant was Linie International Limited a company in the DIFC.

The underlying dispute arose over the employment of the Claimant by the Defendant under an Employment Contract dated 1 April 2019 which stated the Claimant's joining date was1 April 2019.

The Claimant was terminated on 19 December 2019 by way of a letter, and served her last working day on 18 January 2020. On 20 January 2020, the Claimant filed a claim in the DIFC Courts Small Claims Tribunal claiming her end of service entitlements of 53,000 AED and as penalties accrued under Article 19 of DIFC Law No. 2/2019.

The matter was called for a Consultation but the parties failed to reach a settlement.
