Javan v Jasleen Limited

This case involved the delay penalty due for late payment of an employee's dues on termination of employment. A key issue was whether court fees were due for previous legal proceedings and these proceedings and if those amounts should be included in the penalty calculation.

Background

The Claimant was an individual filing a claim against his employer which was a company registered and located in the DIFC.

The claimant was employed by the Defendant under an Employment Contract dated February 2018 as a Head of Investment Banking and began employment on 4 March 2017. Their total salary was 35,000 AED which consisted of 30% of basic wage of 10,500 AED, 30% housing allowance of 10,500 AED and 40% for allowances of 14,000, AED. They were also entitled to 24 working days leave per calendar year and a return ticket for the Claimant and his family to his home country for each 12 months of employment.
