Jaako v Jacey

This case involved non-payment of rent and eviction from a store in the DIFC. Key issues included that as the defendant was absent from the hearing the case could be decided on the claimant's evidence alone. Additional requests were made but as the claim form was not amended these were not considered.

Background

The Claimant was a retail store and the defendant was the occupant of the store.

On 15 August 2015, they entered into a tenancy contract for three years with an annual rent of 125,000 AED. On 1 April 2018 the Defendant stopped paying the rent.

The Claimant sent the Defendant a couple of reminders but they still did not pay. After a failure to reach an amicable solution proceedings were started for the Defendant to pay the rent, court fees and vacate the store

The Defendant failed to file an Acknowledgement of Service, but sent an email to the Registry explaining that she was facing troubles with their business and would be staying in India for an unknown period of time.
