Background

This case involved whether the DIFC SCT had jurisdiction to hear an employment case involving unpaid expenses with a total value less than 500,000 AED.

The Claimant, Irven, was a British national who employed as a Business Development Manager by the Defendant company, Imaar DIFC, an investment business operating in the DIFC.

The Claimant began working for the Defendant on February 2016 as per an employment contract between the parties. He continued working there for almost two years and on 25 October 2017, submitted his resignation letter stating 24 November 2017 was his last working day with the Defendant.

The Defendant provided the Claimant with a Final Settlement agreement under his Employment Contract. When signing the Final Settlement, the Claimant made a note at the end of the page that ‘there are outstanding expenses which I will send to Itzel & appreciate if it can be paid along with the final settlement'. The claimant has been requesting these expenses since then and has not been paid them.
