Itsuo v Inara Holdings Limited
This case involved whether an employee had been dismissed which would mean they were due one month’s pay in lieu of notice or whether they had resigned in which case they would have been due three months’ pay in lieu of notice.
Background
The Claimant is Itsuo was an employee who had been employed with the defendant company which was a registered in the DIFC and located in the DIFC.
The dispute involved the employment of the Claimant under an Employment Contract dated 1 July 2017. The employee actually joined the company on 2 January 2015 in line with an Addendum signed by both parties.
The Claimant was worked for the company as a Chief SCF Officer from 2 January 2015 and received a total salary of 49,000 AED per month which consisted of 24,000 AED basic salary plus allowances of 25,000 AED. The Claimant was also entitled to 30 calendar days paid holiday per calendar year, medical insurance and an annual airfare allowance.
