The claimant lodged the application before the Judicial Tribunal for Dubai Courts and DIFC Courts seeking the decision of the Judicial Tribunal (JT) to decide the Dubai Courts are the competent courts for recognition and enforcement or annulment of the award issued by Dubai International Arbitration Center (DIAC) in the arbitration Case No. 24/2014 DIAC.

The claimant said that on 05/11/2015 an arbitrator issued an award in arbitral case No. 24/2014 DIAC. The claimant brought case No. 371/2016 Real Estate before Dubai Courts which have general jurisdiction for annulment of the arbitral award. The defendant filed application DIFC Case No. 004/2016 before the Courts of Dubai International Financial Centre (DIFC) to recognise and enforce the arbitral award.

On 10/05/2016 the courts of the first instance in DIFC issued a decision, in absence of the claimant, recognising and enforcing the arbitral award. The claimant challenged the decision in the prescribed period of limitation on some grounds including that the Courts of Dubai International Financial Center have no jurisdiction to recognise and enforce the arbitral award. The case has not been adjudicated to date.
