This case involved whether the Dubai courts had jurisdiction over a request involving the time limit for arbitration where the proceedings came under DIFC- LCIA rules.
Background
A developer filed a lawsuit before the Dubai Court of Appeal requesting the court terminate arbitration proceedings which had been filed against them by two investors before the DIFC-LCIA Arbitration Centre on the grounds there was no agreement between the parties to specify a time limit for the proceedings and the rules of the Centre did not regulate on this matter. As a result, the developer argued that Article 42(1) of Federal Law No. 6/2018 should apply which required arbitral awards to be issued in six months, and as there was no agreement to extend the time limit pursuant to Article 41 of Federal Law No. 6/2018 which meant the proceedings had expired.
