This case primarily involved insurance claims after a fire where rented shops were damaged. Key aspects included whether tenants were third parties for insurance purposes, what happened when there were multiple insurances covering the damage and what happened when the insurance had expired.
Background
The first and second Plaintiffs filed suit No. 778 of 2007 against the first, second, third, fourth and fifth Defendants requesting the court oblige them to pay 55,940,823 AED and legal interest from the date of the claim until full payment on the basis that as insurance companies, the Plaintiffs insured against risks, including fire, loss of profit and loss of electronic machines for a number of shops located in a shopping centre on Sheikh Zayed Road in Dubai.
